Sold “as-is, where-is”
Items are being sold in their actual current condition, with all faults and defects, and with all errors of description. Purple Wave and the seller make no warranty as to the condition of the item.
Bidder accepts the item “with all faults”, whether or not immediately apparent. Bidder is responsible for ascertaining actual current condition through personal inspection and careful review of the description, pictures, video and/or support documentation. Bidder accepts that the amounts bid on any items are based solely on the Bidder"s own independent inspection and evaluation of the items.
Purple Wave makes every effort to provide an honest, objective and fair representation of the auction item through the description, photographs, videos and/or support documentation. Bidder accepts that any statements contained in any catalogs (including purplewave.com), brochures and advertisements related to the sale are either expressions of opinion or are for identification purposes only and are not to be relied on by the Bidder as representations of fact.
Bidder should take care to satisfy all questions or concerns before placing a bid. Inspection and contact information for the seller is posted in the item details for each item. Personal, visual inspection of the items is highly recommended. Unless specifically noted, no in-depth operational evaluation has been made.
Buyer is responsible for the cost of packing, shipping and insurance related to the transfer of the items from the seller to the buyer.
All items are sold as described. If the pictures displayed with descriptions do not appear to match, contact support@purplewave.com or call 866.608.9283 to report the auction date and item number.
Announcement priority
All announcements made the day of the sale will take precedence over any printed material, prior announcements and information displayed on this web site.
Assessment of condition
Bidders are responsible for assessing item condition prior to placing a bid. Listings on purplewave.com are intended to be used as an assessment tool; however, we strongly recommend personal inspection of an item prior to bidding.
Abandoned property
Items not claimed within the stated time after the auction will be deemed "abandoned property" and may be resold.
Absentee bids
Purple Wave does accept absentee bids. While we will make every effort to implement absentee bids effectively, we do not make any guarantees. Bids will be made based on bidding increments as listed on the web site and used during the auction. If you would like to place an absentee bid, please request an Absentee Bid Form.
Bid rejection
Purple Wave reserves the right to reject any and all bids.
Bid retraction
Buyers acknowledge all auction terms and agree not to retract the purchase offer. If unable to satisfy the terms of the auction, do not bid.
Credit card payment
A 10% credit card hold may be applied to bids to ensure performance. If the terms of the auction are not followed, Purple Wave reserves the right to charge the entire amount due to the credit card on file, including any storage fees and penalties.
Limit of liability
Purple Wave’s liability to a purchaser will never exceed the purchase price actually paid.
Merchandise removal
Buyer is responsible for making item removal arrangements within two business days of the auction, unless otherwise noted.
Sales tax
All sales are subject to appropriate state sales tax laws.
Transference
Items will not be released until full payment to Purple Wave, Inc., has been received. Merchandise becomes the full responsibility of the buyer at the close of the auction, and buyer assumes all risk of loss and damage to property until removed from sale premises.
