Terms, conditions, explanations and information in addition to those listed on this page are found in the Buy section of this site and on the individual listing pages for all assets included in this auction. All terms, conditions, explanations and information are intended to be supplemental and complimentary to each other. They are incorporated by reference into this page, and collectively they govern this auction. In the event of a conflict or inconsistency among terms, conditions, explanations or information in the Buy section, the individual listing pages for assets and/or this page, the individual listing pages shall control this page and the Buy section, and this page shall control the Buy section. By registering to bid live and/or on the Internet, you agree to abide by all terms and conditions and you acknowledge receipt of all explanations and information made available by Purple Wave.

Consignment deadlines and listing completion
Internet bidding closes one hour before the auction begins. Full payment for Internet purchases must be paid for and picked up no later than 3 p.m. Tuesday, November 18th. (TWO BUSINESS DAYS AFTER AUCTION)

Buyer's premium
A 10% buyer's premium will be added to all winning bids, resulting in the total purchase price. Your Internet bids are a contract and you are responsible for honoring them.

Fees and charges for failing to timely remove or pay for items won
If the winning bidder's credit card information is on file with Purple Wave, that card will be charged for the total purchase price plus one $30 late payment fee if payment is not otherwise timely made. If no credit card information is on file or if the information is insufficient or outdated, a $30 late payment fee will be assessed for each partial or full day beyond the payment deadline for which payment is not made. If items are not timely removed as required above, a $10.00 handling and storage fee will be assessed per auction lot, per day. If an item is not removed within fourteen (14) days after the auction, the item will be considered abandoned property, with all of the buyer's rights and interests in the property extinguished. Purple Wave and/or the seller reserve the right to pursue all legal remedies.

  Items are located at 2306 Vine Street in Hays, Kansas. On Friday, November 14 items will be moved to the the Ellis County Fairgrounds in Hays, Kansas. Items won via internet bid will be returned to the Purple Wave Hays facility immediately following the auction. Pickup times are Monday, November 17 and Tuesday, November 18 from 9 a.m. to 3 p.m.

Payment information
All payments must be made to a Purple Wave location. Buyers attending the auction in person must pay for their purchased items on auction day. Buyers who do not attend the auction and who win via an Internet bid must pay for their purchased items by 3:00 p.m. on the second business day after the auction. Every day except Sunday is considered a business day. Cash and wire transfers (wire instructions) in any amount will be accepted. Checks up to $10,000.00 will be accepted without a bank guaranty letter. Checks of $10,000.00 or greater will be accepted only with a bank guaranty letter (letter requirements) or with prior approval from Purple Wave's credit department. MasterCard or Visa will be accepted only for charges up to $2,000.00, and only after email authorization or in-person signatures are obtained from the cardholder. Purple Wave reserves the right to hold assets and/or certificates of title until funds availability is confirmed.

Item removal requirement
Unless prior alternate arrangements are made with Purple Wave, a buyer who attends the auction in person must remove his or her purchased items from the auction site on auction day. If a buyer does not attend the live auction or purchases items located other than at the auction site, the buyer must claim and remove his or her purchased items from their respective location by 3:00 p.m. on the second business day after the auction. Every day except Sunday is considered a business day. A paid receipt is required to remove items from the premises. Purple Wave may provide equipment or labor to assist with item load out as a courtesy, but Purple Wave shall not be held responsible for safe loading, load security and safety, or damage to equipment, vehicles or persons occurring during or after the load out process.
