Terms, conditions, explanations and information in addition to those listed on this page are found in the Buy section of this site and on the individual listing pages for all assets included in this auction. All terms, conditions, explanations and information are intended to be supplemental and complimentary to each other. They are incorporated by reference into this page, and collectively they govern this auction. In the event of a conflict or inconsistency among terms, conditions, explanations or information in the Buy section, the individual listing pages for assets and/or this page, the individual listing pages shall control this page and the Buy section, and this page shall control the Buy section. By registering to bid live and/or on the Internet, you agree to abide by all terms and conditions and you acknowledge receipt of all explanations and information made available by Purple Wave.

Internet bidding
This is an Internet-only auction, which means the highest bid online when the bidding closes on a particular item will be the winning bid for that item. Bidding for items will begin to close one item per five (5) minutes at 10:00 a.m. CDT on Monday, December 29. The items will close in the order listed on the website. This auction will feature our automatic extension system which will grant a five (5) minute extension to the end of the auction of any item receiving a bid during the last five (5) minutes. The item will then close when five (5) minutes have elapsed without any bidding activity. This auction will also utilize our grouped extension for three groups of assets: Combines, trailers and platforms. Learn more about our grouped extension feature. Unless otherwise noted, items in this auction are selling without reserve, and all Internet bids are treated as if they were given at a live auction. All bidders will be held accountable for their Internet bids.

Buyer's premium
A 10% buyer's premium will be added to all winning bids, resulting in the total purchase price.

Payment information
All payments must be made to a Purple Wave location by 3:00 p.m. on Saturday, January 3, 2009. Cash, cashiers checks, and wire transfers (wire instructions) in any amount will be accepted. Business and personal checks up to $10,000.00 will be accepted without a bank guaranty letter. Business and personal checks of $10,000.00 or greater will be accepted only with a bank guaranty letter (letter requirements) or with prior approval from Purple Wave's credit department. MasterCard or Visa will be accepted only for charges up to $2,000.00, and only after email authorization or in-person signatures are obtained from the cardholder. Purple Wave reserves the right to hold assets and/or certificates of title until funds availability is confirmed. Unless a deposit or acceptable bank guaranty letter is delivered to Purple Wave prior to the close of bidding, by placing bids you authorize Purple Wave at its discretion to place a hold on your credit card for up to 10% of your projected or actual invoice total.

Qualifying bids and bidders
By registering to bid in this auction, you authorize Purple Wave to verify your qualification to bid. Verification may include placing a hold on your credit card, obtaining credit or bank references from third parties, obtaining deposits of any amount and/or obtaining bank guaranty letters. Purple Wave may take any or all of these measures at any point prior to or after your first bid and at any point during the auction. Purple Wave reserves the right to strike any Internet bid if the bidder refuses or fails to timely cooperate with Purple Wave's efforts to verify the bidder's qualification to bid. By registering to bid in this auction, you authorize all credit references, banks and credit reporting agencies to provide complete information about your credit to Purple Wave.

Fees for failing to timely pay for items won
If payment is not timely made as required above, the winning bidder's credit card on file with Purple Wave will be charged for some or all of the bidder's invoice amount, including late fees, at Purple Wave's discretion. Additionally, a $30 late payment fee will be assessed for each partial or full day beyond the payment deadline for which payment is not made. Purple Wave and the seller reserve the right to pursue all legal remedies.

Inspection times are December 28 from 9 a.m. to 4 p.m. and by appointment. A limited number of computers will be available for Internet bidding at this location on auction day for bidders desiring to place bids then and there. Pickup times are by appointment. Personnel and vehicle start assistance will be available during loadout.

Item removal requirement
A paid receipt must be presented to pick up won items. Purple Wave reserves the right to hold assets and/or certificates of title until funds availability is confirmed. If you pay be personal or business check without a bank guaranty letter, please check with Purple Wave to ensure that your funds have been confirmed before making pickup arrangements with seller.

Shipping
Winning bidders are responsible for their own shipping and may use the shipping firm of their choice. The seller of items in Logan, Kansas, will provide shipping quotes upon request - contact Glen at 785.689.7526 or [email protected].
