Terms, conditions, explanations and information in addition to those listed on this page are found in the Buy section of this site and on the individual listing pages for all assets included in this auction. All terms, conditions, explanations and information are intended to be supplemental and complimentary to each other. They are incorporated by reference into this page, and collectively they govern this auction. In the event of a conflict or inconsistency among terms, conditions, explanations or information in the Buy section, the individual listing pages for assets and/or this page, the individual listing pages shall control this page and the Buy section, and this page shall control the Buy section. By registering to bid live and/or on the Internet, you agree to abide by all terms and conditions and you acknowledge receipt of all explanations and information made available by Purple Wave.

Deadlines and close of Internet bidding
The items will begin to close one item per minute at 10:00 a.m. CDT on Wednesday, January 28 and will sell to the winning Internet buyers at that time. The items will close in the order listed on the website. This auction will feature our automatic extension system which grants a five minute extension to the end of the auction of any item receiving a bid during the last few minutes. The item will then close when five minutes have elapsed without any activity. This auction will also utilize our grouped extension for three groups of assets: Trash trucks, Mack trucks, and Curtis cast spreaders. Learn more about our grouped extension feature.

Buyer's premium
A 10% buyer's premium will be added to all winning bids, resulting in the total purchase price. Your Internet bids are a contract and you are responsible for honoring them.

Fees and charges for failing to timely remove or pay for items won
If the winning bidder's credit card information is on file with Purple Wave, that card will be charged for the total purchase price plus one $30 late payment fee if payment is not otherwise timely made. If no credit card information is on file or if the information is insufficient or outdated, a $30 late payment fee will be assessed for each partial or full day beyond the payment deadline for which payment is not made. If items are not timely removed as required above, a $10.00 handling and storage fee will be assessed per auction lot, per day. If an item is not removed within fourteen (14) days after the auction, the item will be considered abandoned property, with all of the buyer's rights and interests in the property extinguished. Purple Wave and/or the seller reserve the right to pursue all legal remedies.

Payment information
All payments must be made to a Purple Wave location. Buyers who win via an Internet bid must pay for their purchased items by 3:00 p.m. on the second business day after the auction. Every day except Sunday is considered a business day. Cash and wire transfers (wire instructions) in any amount will be accepted. Checks up to $10,000.00 will be accepted without a bank guaranty letter. Checks of $10,000.00 or greater will be accepted only with a bank guaranty letter (letter requirements) or with prior approval from Purple Wave's credit department. MasterCard or Visa will be accepted only for charges up to $2,000.00, and only after email authorization or in-person signatures are obtained from the cardholder. Purple Wave reserves the right to hold assets and/or certificates of title until funds availability is confirmed.

Qualifying bids and bidders
By registering to bid in this auction, you authorize Purple Wave to verify your qualification to bid. Verification may include placing a hold on your credit card, obtaining credit or bank references from third parties, obtaining deposits of any amount and/or obtaining bank guaranty letters. Purple Wave may take any or all of these measures at any point prior to or after your first bid and at any point during the auction. Purple Wave reserves the right to strike any Internet bid if the bidder refuses or fails to timely cooperate with Purple Wave's efforts to verify the bidder's qualification to bid. By registering to bid in this auction, you authorize all credit references, banks and credit reporting agencies to provide complete information about your credit to Purple Wave.

Item removal requirement
After having paid, merchandise must be removed in accordance with the removal terms listed for each item location above. A paid receipt must be presented to remove items from the premises.

KHP disclaimer and specific terms
The Kansas Highway Patrol offers the list of seized vehicles to the highest bidder with no reserve. All vehicles were running at the time of seizure but the Kansas Highway Patrol does not have prior Knowledge to the vehicles past history. Therefore the KHP will NOT assume any responsibility for the reliability or the service ability of any vehicle.
NON-REPAIRABLE VEHICLES

• A non-repairable vehicle can NEVER be registered or re-titled for use on the road or highways.
• The following statement has been signed by the KHP that states:
  I, the undersigned, certify that this vehicle has been damaged, destroyed, wrecked, burned or submerged in water to the extent that such motor vehicle is incapable of safe operation for use on roads or highways and has no resale value except as a source of parts or scrap only, or that as owner, I irreversibly designate this vehicle as a source of parts or scrap.
• The statement above includes Dealers as well as the public.
• NO ONE can title this vehicle for use on the highway within any jurisdiction of United States. Please be aware of this prior to making any bid on a vehicle labeled as "non-repairable".
