Terms, conditions, explanations and information in addition to those listed on this page are found in the Buy section of this site and on the individual listing pages for all assets included in this auction. All terms, conditions, explanations and information are intended to be supplemental and complimentary to each other. They are incorporated by reference into this page, and collectively they govern this auction. In the event of a conflict or inconsistency among terms, conditions, explanations or information in the Buy section, the individual listing pages for assets and/or this page, the individual listing pages shall control this page and the Buy section, and this page shall control the Buy section. By registering to bid live and/or on the Internet, you agree to abide by all terms and conditions and you acknowledge receipt of all explanations and information made available by Purple Wave.

Internet bidding
This is an Internet-only auction, which means the highest bid online when the bidding closes on a particular item will be the winning bid for that item. Bidding for items will begin to close one item per minute at 10:00 a.m. CDT on Thursday, September 17. The items will close in the order listed on the website. This auction will feature our automatic extension system which will grant a five (5) minute extension to the end of the auction of any item receiving a bid during the last five (5) minutes. The item will then close when five (5) minutes have elapsed without any bidding activity. Unless otherwise noted, items in this auction are selling without reserve, and all Internet bids are treated as if they were given at a live auction. All bidders will be held accountable for their Internet bids.

Buyer's premium
A 10% buyer's premium will be added to all winning bids, resulting in the total purchase price. Your Internet bids are a contract and you are responsible for honoring them.

Fees and charges for failing to timely remove or pay for items won
If the winning bidder's credit card information is on file with Purple Wave, that card will be charged for the total purchase price plus one $30 late payment fee if payment is not otherwise timely made. If no credit card information is on file or if the information is insufficient or outdated, a $30 late payment fee will be assessed for each partial or full day beyond the payment deadline for which payment is not made. If items are not timely removed as required above, a $10.00 handling and storage fee will be assessed per auction lot, per day. If an item is not removed within fourteen (14) days after the auction, the item will be considered abandoned property, with all of the buyer's rights and interests in the property extinguished. Purple Wave and/or the seller reserve the right to pursue all legal remedies.

  Removal timeline: Unless other removal arrangements are made with the removal contact within 48 hours from the end of the auction, fees for failing to timely remove items won may be assessed under the auction terms and conditions. All items must be removed by Thursday, October 1. Items not removed by Thursday, October 1 will be subject to penalty up to and included additional storage and administration fees and item forfeiture.
  

Payment information
All payments must be made to a Purple Wave location. Buyers who win via an Internet bid must pay for their purchased items by the end of business on the second business day after the auction. Every day except Saturday and Sunday is considered a business day. Business hours are Monday through Friday 8 a.m. to 5 p.m Cash and wire transfers (wire instructions) in any amount will be accepted. Checks up to $10,000.00 will be accepted without a bank guaranty letter. Checks of $10,000.00 or greater will be accepted only with a bank guaranty letter (letter requirements) or with prior approval from Purple Wave's credit department. MasterCard or Visa will be accepted only for charges up to $2,000.00, and only after email authorization or in-person signatures are obtained from the cardholder. Purple Wave reserves the right to hold assets and/or certificates of title until funds availability is confirmed.

Qualifying bids and bidders
By registering to bid in this auction, you authorize Purple Wave to verify your qualification to bid. Verification may include placing a hold on your credit card, obtaining credit or bank references from third parties, obtaining deposits of any amount and/or obtaining bank guaranty letters. Purple Wave may take any or all of these measures at any point prior to or after your first bid and at any point during the auction. Purple Wave reserves the right to strike any Internet bid if the bidder refuses or fails to timely cooperate with Purple Wave's efforts to verify the bidder's qualification to bid. By registering to bid in this auction, you authorize all credit references, banks and credit reporting agencies to provide complete information about your credit to Purple Wave.

Item removal requirement
After having paid, merchandise must be removed in accordance with the removal terms listed for each item location above. A paid receipt must be presented to remove items from the premises. Buyers who incur storage fees as a result of late pickup must present a paid receipt for the total invoice price and all storage fees before removing items from the premises.

Shipping and Transportation
Shipping is available on the items in this auction. Purple Wave has partnered with MachineryLink Transport to provide shipping and transportation services to winning bidders. MachineryLink Transport generally does not facilitate shipment for items weighing less then 150lbs. Unless otherwise stated on the item shipment for items weighing less then 150lbs, shipping is not available. See MachineryLink Transport details for more information.

MachineryLink Transport will recommend the safest, most reliable and cost effective transportation options.

Any shipping/transportation arrangements are ultimately between the buyer and the shipping company and not Purple Wave.

Winning bidders may choose to make transportation arrangements themselves, provided that all removal terms and conditions are met. Purple Wave does not provide packing or rigging services.
