Terms, conditions, explanations and information in addition to those listed on this page are found in the Terms and Conditions section of this site and on the individual listing pages for all assets included in this auction. All terms, conditions, explanations and information are intended to be supplemental and complimentary to each other. They are incorporated by reference into this page, and collectively they govern this auction. In the event of a conflict or inconsistency among terms, conditions, explanations or information in the Terms and Conditions section, the individual listing pages for assets and/or this page, the individual listing pages shall control this page and the Terms and Conditions section, and this page shall control the Terms and Conditions section. By registering to bid live and/or on the Internet, you agree to abide by all terms and conditions and you acknowledge receipt of all explanations and information made available by Purple Wave.
Douglas County specific terms
- Douglas County reserves the right to accept or reject any or all bids until payment is tendered and accepted by Douglas County.
- All items are offered on an "as is","where is" basis without warranty or guarantee of any kind, either expressed or implied.
- All information for vehicles, equipment or items offered for sale is intended to be as accurate as possible. However, bidders are urged to examine the vehicles, equipment and items before bidding, An error or omission in the listing will not change the results of the bid.
- This list is subject to change.
- Vehicles, equipment and items will be available for inspection by the public at designated times preceding the auction date.
- Mileage may vary by 15 miles. Hours may vary by 10 hours.
- Kansas sales tax will be added to all equipment and item purchases with the exception of vehicles, the tax on which is to be paid at the time of the vehicle registration at any county tag office.
- Sales Tax Exemption Certificates for resale or agricultural use shall be completed by the buyer.
- No "open" Certificates of Title will be issued to the buyer. The Assignment of Title section on the reverse side of the title must be completed with the Buyer's Name, Company, etc., at the time of payment.
- In case of default, the municipality may sell the vehicles, equipment, and items to backup bidders and hold the original bidder or contractor liable for resulting losses to Douglas County.
- All vehicles, equipment, and items purchased become the responsibility of the buyer at the time the item is "knocked down" by the auctioneer.
- It is the successful bidder's responsibility of pick up and load his or her items at the designated locations.
Internet bidding
This is an Internet-only auction, which means the highest bid online when the bidding closes on a particular item will be the winning bid for that item. Bidding for items will begin to close two items per minute at 10:00 a.m. CST on Tuesday, December 8. The items will close in the order listed on the website. This auction will feature our automatic extension system which will grant a five (5) minute extension to the end of the auction of any item receiving a bid during the last five (5) minutes. The item will then close when five (5) minutes have elapsed without any bidding activity. Unless otherwise noted, items in this auction are selling without reserve, and all Internet bids are treated as if they were given at a live auction. All bidders will be held accountable for their Internet bids.
Inspection prior to bidding
All items, unless stated otherwise, are sold "as is, where is" . Bidders are responsible for assessing item condition prior to placing a bid. We strongly recommend personal inspection of items prior to bidding. Purchaser buys entirely on his own examination. It is the responsibility of the buyer to conduct any inspection and examination necessary to satisfy him of all material facts before placing a bid.
All sales are final. No refunds given. Credit card transactions may not be reversed.
Titled Assets / Transfer of Ownership
Titled assets selling on www.purplewave.com are checked for transferability prior to appearing on our website. Titled assets will have a government issued title or documentation necessary for transfer of ownership. Titled assets with "Salvage", "Non-Highway" or other brands are typically included in the description, however it is the responsibility of the bidder to investigate title history and registration. Purple Wave is not responsible for undisclosed title brands, back registration fees or whether or not a vehicle will pass inspection.
Qualifying bids and bidders
Bids over the amount of $10,000.00 are subject to Purple Wave's qualification process. Verification may include, but is not limited to, providing a bank letter of guarantee, credit references or credit card pre-authorization. Purple Wave may take any or all of these measures at any point during the auction. Purple Wave reserves the right to strike any Internet bid if the bidder refuses or fails to timely cooperate with Purple Wave's efforts to verify the bidder's qualification to bid. By registering to bid in this auction, you authorize all credit references, banks and credit reporting agencies to provide complete information about your credit to Purple Wave. Sales taxes
State law requires Purple Wave collect sales tax on all applicable transactions. Tax rates are based on the item's location and are applied to the total purchase price (hammer price plus the Buyer's Premium). Tax will be collected unless the buyer provides proof of a tax exemption, which must be submitted before tax amounts will be removed from the invoice. Exemption forms are auction specific and will need to be completed for every event. Purple Wave cannot offer advice, opinions or guarantees about whether you are in fact exempt. Consult your tax advisors if you have eligibility questions. Purple Wave, Inc. cannot be held responsible for States' registration requirements in regards to exemptions. Please note, guidelines and regulations regarding tax exemptions may vary between states. Sale order
Items in this auction are sorted by bid amount until 24 hours prior to the auction. The items will be sorted in their final sale order 24 hours prior to the auction.
Payment information
Payments must be made by 4 p.m. CST on the second business day following the auction. Purple Wave reserves the right to charge the credit card on file the total purchase price, $30.00 late payment fee for invoices not paid within our terms. Business hours are Monday through Friday 8 a.m. to 5 p.m CST. Cash and wire transfers (wire instructions) in any amount will be accepted. Checks up to $10,000.00 will be accepted without a bank guaranty letter. Checks of $10,000.00 or greater will be accepted only with a bank guaranty letter (letter requirements) or with prior approval from Purple Wave's credit department. MasterCard or Visa will be accepted only for charges up to $2,000.00, and only after authorization (via website or email) or in-person signatures are obtained from the cardholder. Purple Wave reserves the right to hold assets and/or certificates of title until funds availability is confirmed.
Item removal requirement
Merchandise must be removed in accordance with the removal terms listed for each item location above. A paid receipt must be presented to remove items from the premises. Buyers who incur storage fees as a result of late pickup must present a paid receipt for the total invoice price and all storage fees before removing items from the premises. Item's not removed within fourteen (14) days after the auction are subject to penalty up to and including additional storage fees, administration fees and item forfeiture. Purple Wave and/or seller reserve the right to pursue legal remedies.
Default Charges
If a auction transaction is defaulted on for any reason, Purple Wave reserves the right to charge the winning bidder a default fee. The default fee is 15% of the hammer price (with a minimum of $100.00). Purple Wave and/or the seller reserve the right to pursue all legal remedies. If unable to satisfy the terms of auction, do not bid.
